You went through the LTB process, got an eviction order, and the tenant still has not left. This situation is more common than most landlords expect. Ontario’s Residential Tenancies Act has a specific process for what happens next — and taking shortcuts can create serious legal problems.
You Cannot Remove the Tenant Yourself
Under the Residential Tenancies Act, it is illegal for a landlord to physically remove a tenant, change the locks, or interfere with the tenant’s possessions — even after an eviction order. Doing so can result in fines of up to $25,000 for individuals. The only person who can enforce an eviction order is a Court Enforcement Officer (Sheriff).
How to Request Sheriff Enforcement
Once the compliance date on the LTB order passes and the tenant has not vacated, you can file a Request to Enforce an Order (Form L4) with the LTB, or contact the Court Enforcement Office directly. You will pay an enforcement fee, and the Sheriff will schedule a date to attend the unit.
What Happens on Enforcement Day
The Sheriff will attend the unit and physically oversee the eviction. They will give the tenant a final opportunity to leave voluntarily before proceeding. If the tenant refuses, the Sheriff has authority to remove them and secure the unit for the landlord.
What About the Tenant’s Belongings?
If the tenant leaves belongings behind, Ontario law requires landlords to follow specific rules before disposing of them. You generally must store them for a period of time and give the tenant written notice. Throwing belongings out immediately after an eviction can result in a tenant application against you.
Review and Appeal Risks
Between the LTB order and Sheriff enforcement, the tenant may file a motion to review or a stay of the order. If granted, this can pause enforcement while the matter is re-heard. This is another reason having legal representation throughout the process is important — someone needs to respond to these motions quickly.
