The N11 is a voluntary agreement between a landlord and tenant to end the tenancy on a specific date. When used correctly, it is one of the cleanest ways to get vacant possession in Ontario. When used incorrectly — or signed under duress — it can be set aside by the LTB.

What the N11 Is and Is Not

The N11 is a mutual agreement — both parties must genuinely agree to end the tenancy. It is not a notice the landlord serves unilaterally. If the tenant feels pressured, coerced, or did not fully understand what they were signing, the LTB has the authority to void the N11 and reinstate the tenancy.

When Landlords Use the N11

The N11 is most commonly used in cash-for-keys situations — the landlord offers a financial incentive and both parties agree to end the tenancy on a specific date. It is also used when a tenant gives notice to leave and both parties want to formalize the end date.

The Termination Date Must Be a Fixed Date

The N11 must specify a precise termination date — not a range, not ‘within 30 days.’ If the date is ambiguous or missing, the agreement may not be enforceable. The tenant has the right to remain until that exact date.

What Happens If the Tenant Changes Their Mind

An N11 signed and agreed to by both parties is generally binding. If the tenant refuses to leave by the termination date, you can file an L3 application with the LTB — a faster process than starting from scratch with a new notice. This is one of the key advantages of using an N11 rather than just a verbal agreement.

Protecting the Agreement

To reduce the risk of the N11 being challenged, ensure it is signed without pressure, the tenant has time to consider it, and the agreement documents any payment or consideration clearly. A paralegal or lawyer can help structure a cash-for-keys agreement properly to minimize dispute risk.
