Ontario landlords preparing LTB applications often focus on the notice itself — making sure the N4 is accurate, the N12 meets the legal requirements, the amounts are correct. But a form that was served improperly — or that cannot be proven to have been served — may be treated as if it was never delivered. The Certificate of Service is how you prove service happened.
What the Certificate of Service Is
A Certificate of Service is a document signed by the person who served the notice, confirming: the name of the tenant served, the address, the date and time of service, the method of service used, and if personal service, who received it. It is signed under oath or affirmation and submitted as part of the LTB application.
When to Complete It
Complete the Certificate of Service at the time of service — not days later. Memory fades, and a Certificate completed weeks after the fact is far less credible than one completed immediately. If you are serving a notice by mail, complete the Certificate the same day you put it in the mail and keep the receipt if possible.
What Happens If Service Is Disputed
Tenants routinely dispute service at LTB hearings. If the tenant says they never received the notice, the LTB will look at the Certificate of Service. If there is no Certificate, or if the Certificate is vague, the adjudicator may find that proper service was not established — and dismiss the application. This is one of the most common and avoidable reasons applications fail.
Multiple Service Attempts
If your first service attempt failed, document each attempt and complete a separate Certificate of Service for each. The LTB wants to see a genuine effort to notify the tenant. Multiple documented attempts demonstrate good faith and strengthen your position if service is questioned.
