Landlord guide · LTB process

Does the LTB Give Legal Advice to Ontario Landlords?

No. The LTB provides information, not legal advice. Its staff can explain forms and processes, but they can’t tell you whether your notice is valid or how to win your case. Here is what that means for landlords.

Key points

  • LTB Contact Centre staff give information about the law and process, not legal advice.
  • Adjudicators are neutral and can’t tell you how to present your case.
  • The tenant may get free advice from tenant duty counsel. Landlords don’t have an equivalent service.
  • A licensed paralegal can advise and represent you.

Landlords often call the LTB expecting guidance on their specific situation and are frustrated by the answer. That isn’t the Board being unhelpful. It is the Board staying neutral.

What the LTB will tell you

The LTB Contact Centre can provide information about the Residential Tenancies Act and the Board’s processes. Its website has forms, instructions, brochures and Interpretation Guidelines that explain how the Board usually applies the law.

What it won’t

  • Whether your situation meets the test for a particular notice.
  • Whether your N4 or N12 is filled out correctly before you serve it.
  • Whether your case is strong or weak.
  • What evidence you should bring.

At the hearing

The adjudicator is in charge of the hearing but can’t give legal advice or tell you how to present your case. It is up to you to present evidence that supports your position. Tenants can often get free legal advice from tenant duty counsel through Legal Aid Ontario, so a landlord without help can be at a disadvantage.

Where to get advice

A paralegal licensed by the Law Society of Ontario can advise you on your situation and represent you at the LTB. See LTB paralegal vs lawyer. Getting advice before serving a notice is far cheaper than discovering an error at the hearing, when the only fix is a new notice and another wait.

Frequently asked questions

Can the LTB tell me if my N12 is valid?

No. Staff provide information, not legal advice.

Can the adjudicator help me at the hearing?

The adjudicator runs the hearing and may ask questions, but can’t give legal advice or tell you how to present your case.

Is there free legal help for landlords?

Tenant duty counsel serves tenants. Landlords usually hire a paralegal or lawyer.

Can a paralegal represent me at the LTB?

Yes. Licensed paralegals can advise landlords and represent them at the LTB.

Where can I find the LTB’s own guidance?

On the Tribunals Ontario website: forms, instructions, brochures and Interpretation Guidelines.
