What Is an N4 Notice? A Landlord’s Guide

When a tenant falls behind on rent, the clock starts ticking. Ontario’s Residential Tenancies Act gives landlords a defined process to follow — and it starts with the N4 Notice to End a Tenancy Early for Non-payment of Rent. If this notice isn’t served correctly, the entire application to the LTB can be thrown out.

What the N4 Does

The N4 is a formal notice informing the tenant of the exact rent amount owing and giving them an opportunity to pay before you can file an application with the Landlord and Tenant Board. It is not an eviction order — it is a required first step in the eviction process for non-payment.

When You Can Serve an N4

You can serve an N4 as soon as rent is one day late. However, the notice must state the correct amount of rent owing and the correct dates. An N4 that overstates the rent — even by a small amount — can be voided at an LTB hearing.

The 14-Day Waiting Period

Once the N4 is served, the tenant has 14 days to pay the full amount owing or move out. If they pay in full, the notice is void and you cannot file an L1 application based on it. If they don’t pay and don’t leave, you can then file an L1 application to terminate the tenancy and collect the rent owed.

How the N4 Must Be Served

Acceptable service methods include hand delivery, leaving it in the mailbox, mail, email (if the tenant has agreed in writing), or leaving it with an adult in the unit. A notice served by the wrong method can be successfully challenged at the LTB.

Common Mistakes That Void an N4

The most frequent errors include: including NSF fees in the rent amount, using the wrong termination date, incorrectly calculating the rent period, and serving by an invalid method. Any of these can result in a dismissed application — meaning you start the process over.
