If you receive an LTB order that you believe was made in error, you have a limited window to request a review. The deadline is strict, the grounds are narrow, and missing it can mean the order is final. Here is what Ontario landlords need to understand about the review process.
What a Review Is — and Isn’t
A Request for Review is not an appeal on the merits of the decision. It is a procedural mechanism to correct specific types of errors: serious errors of law, failure to follow natural justice (for example, a party was not given an opportunity to be heard), or situations where the LTB made a serious error on the face of the order.
The 15-Day Deadline
You have 15 days from the date the order is issued to file a Request for Review. This deadline is not flexible. If you discover an error on day 16, your options are significantly more limited. The order takes effect and enforcement can proceed even while a review is pending unless you also obtain a stay.
How to Request a Stay of the Order
Filing a review does not automatically pause enforcement. If you need time while the review is being considered, you must separately request a stay of the eviction order. A stay is not automatically granted — you need to demonstrate grounds and the balance of prejudice to both parties.
What Grounds Qualify for a Review
Not every unfavourable decision qualifies for review. ‘I disagree with how the adjudicator weighed the evidence’ is generally not sufficient. Grounds that do qualify include: you were not notified of the hearing date, a serious error of law was made, or there are new facts that could not have been discovered before the original hearing.
Acting Immediately Is the Only Option
When you receive an LTB order you believe is wrong, every day counts. The 15-day window starts from the order date — not from when you opened the mail or read the email. If you are managing your own LTB file without representation, this is a particularly high-risk moment.
