The N5 is one of Ontario’s most misunderstood eviction notices. It is used for situations beyond unpaid rent — damage, interference with other tenants, overcrowding — and it comes with a voiding period that gives tenants a chance to fix the problem. Most landlords do not know how to use it correctly.

What the N5 Is For

The N5 Notice to End a Tenancy for Interfering with Others, Damage or Overcrowding covers three distinct situations: damage to the rental property, interference with the reasonable enjoyment of other tenants or the landlord, and overcrowding beyond what the unit is approved for.

The 7-Day Voiding Period (First N5)

The first N5 you serve gives the tenant 7 days to stop the behaviour or fix the damage. If they comply within that period, the notice is void and you cannot file an application based on it. This is not optional — it is built into the statute.

The Second N5: No Voiding Period

If the same issue occurs again within 6 months of the first N5, you can serve a second N5. This one has no voiding period — the tenant cannot cure it, and you can file an L2 application immediately. This is why documentation of each incident matters so much.

What Counts as Damage

Damage beyond normal wear and tear is covered by the N5. Normal wear and tear — scuff marks on walls, carpet worn from foot traffic — does not qualify. Holes in walls, broken appliances caused by tenant misuse, and deliberately damaged fixtures are examples of what the N5 is designed to address.

Documenting the N5 Properly

Describe the damage or interference specifically on the N5 — vague descriptions give tenants grounds to argue at the hearing. Attach photographs and written records. Specify the dates, times, and nature of each incident. The more specific the notice, the harder it is to challenge at the LTB.
