Ontario’s N4 notice — the first step in any eviction for non-payment of rent — has been subject to regulatory updates affecting how it must be completed and served. Landlords still using outdated forms or old procedures are at risk of having their applications dismissed before they even get a hearing.
Why the N4 Changes Matter
The LTB requires that applications and notices use the current, approved versions of all forms. An N4 completed on an outdated template can be rejected at the screening stage. This has caught many landlords off guard, especially those who have handled their own applications in the past and are reusing old documents.
What Changed in Recent Updates
Recent regulatory changes in Ontario have affected the N4 in areas including how rent owing is calculated, what fees can and cannot be included, and the termination date requirements. Bill 60 changes also introduced amendments to LTB procedures that affect how applications are processed.
What Must Be Correct on the N4
The N4 must state the exact amount of rent owing — no more, no less. NSF fees, late fees, and utilities cannot be included in the rent owing amount. The termination date must be the correct number of days from service. The rental period and payment frequency must be accurately reflected.
How Errors Sink N4 Applications
The LTB screens applications before scheduling hearings. An N4 with an incorrect termination date or inflated rent amount can result in a requisition — a request to correct the application — or outright dismissal. Even a small overstatement of rent gives the tenant grounds to void the notice at the hearing.
Staying Current on Form Requirements
The LTB publishes updated forms on the Tribunals Ontario website. Landlords who file their own applications should check the form version before every application. The simplest way to avoid this issue entirely is to have a licensed paralegal prepare and file on your behalf — they are responsible for using current forms.
