Ontario’s Bill 60 and related legislative changes have introduced amendments to how the LTB processes applications, how notices are completed, and what landlords can claim. If you are managing a rental property and have not reviewed what changed, there may be gaps in how you are handling your files.
Changes to the N4 Notice
Recent regulatory amendments have clarified what can and cannot be included in an N4’s rent owing amount. NSF fees, late fees, and other charges that are not base rent cannot be included. The permitted notice periods and termination date requirements have also been subject to LTB interpretation through recent decisions.
N12 and Purchaser’s Own Use Provisions
Legislative changes have tightened the scrutiny applied to N12 applications, particularly purchaser’s own use applications in the context of property sales. Bad faith penalties have been maintained and the LTB has been applying them consistently. Landlords using the N12 in a sale context need to understand the genuine intention requirement thoroughly.
LTB Process Changes
The LTB has moved toward greater use of written hearings for straightforward applications and virtual hearings for most contested matters. Landlords who prefer in-person hearings will find that option is no longer the default. Understanding the virtual process and how to present evidence effectively through it is now essential.
Expanded Adjudicator Capacity
The government has increased the number of LTB adjudicators to address the backlog. This has had some impact on scheduling times for certain application types. However, the improvement is uneven — some regions and application types still face significant delays.
Keeping Your Process Current
The RTA and its regulations change through legislation, regulation, and LTB policy directives. Landlords who manage their own files need to actively monitor these changes. A form or procedure that was correct last year may not be correct today.
