Ontario tenants facing an L1 hearing are not defenceless. They have access to legal aid, tenant duty counsel, and a list of established defences that experienced representatives know how to deploy. Landlords who underestimate this leave hearings without their order — or with a conditional one that still does not resolve the problem.

The Most Common Defences Tenants Use

The most frequently raised defences at L1 hearings include: the rent amount stated on the N4 is wrong (even by a small amount), the notice was not properly served, the landlord failed to maintain the property in a good state of repair, the landlord harassed or interfered with the tenant, or the tenant claims they paid and the landlord did not credit the payment.

The Maintenance Defence

Under section 82 of the Residential Tenancies Act, a tenant can raise maintenance issues at an L1 hearing even if those issues were not part of the original application. If the LTB agrees that the landlord failed to maintain the unit, it can reduce or withhold the amount of arrears owed. This is why a clean maintenance record matters.

The Improper Notice Defence

If the N4 overstates the rent owed — even by one cent — it can be voided at the hearing. If service was improper, the same result. Tenants and their representatives know to look for these errors. Landlords who prepare their own notices without legal knowledge often give away the case before the hearing starts.

How Landlords Win

The landlord with the strongest position is the one who: served a clean, accurate N4; can prove service; has a clear rent ledger; maintained the property in good repair; and documented all communications. These are not complicated requirements — they just require consistent record-keeping from the beginning of the tenancy.

Duty Counsel and Legal Aid

Many tenants are assisted by duty counsel on hearing day — a free legal representative provided to tenants at the LTB. If you show up without representation, you may be facing someone who does this all day. Having your own paralegal levels the playing field significantly.
