Most landlords who show up to an LTB hearing unprepared are at a serious disadvantage — especially when the tenant has a representative. Here is a practical checklist of what to have ready, how to organize it, and what to expect in the hearing room (or virtual session).

Know Your Application and What You Are Claiming

Before the hearing, review your application carefully. Know the exact amount of rent you are claiming, the dates it is owed, and what order you are asking the LTB to make. If the amount has changed since you filed — because of partial payments or additional arrears — be prepared to explain that clearly.

Organize Your Evidence

Evidence at an LTB hearing must be relevant and organized. For an L1 application, your evidence should include the lease, the N4 notice, proof of service of the N4, a ledger showing rent owed and received, and any written communication relevant to the arrears. Have it organized chronologically and ready to share.

Understand How Service Is Proved

If the tenant denies receiving the notice, you need to prove service. A Certificate of Service completed at the time of delivery is the standard. If you served by mail, know the deemed service rules. If service is defective, the LTB may dismiss your application regardless of the merits.

Prepare for What the Tenant Might Raise

At a hearing, the tenant may raise maintenance issues, claim the landlord harassed them, or argue the rent amount is wrong. Think through every potential challenge and have your response ready. If the property had maintenance issues, be prepared to show what you did and when.

Virtual Hearings: Technical Readiness Matters

Most LTB hearings are now conducted virtually via videoconference. Test your technology the day before. Know how to share documents on screen. Have your evidence in digital form ready to display. A technical failure on hearing day is not automatically granted an adjournment.
